EEOC Proposes Ending EEO-1 Annual Race and Sex Reporting

What changed

EEOC proposed rescinding the EEO-1 through EEO-6 annual race and sex reports and related recordkeeping (NPRM published July 23, 2026, 91 FR 46332); a public hearing was held Aug. 11 and comments closed Aug. 24, 2026. Nothing is rescinded until a final rule is published.

Who it applies to

Private employers with 100 or more employees and federal contractors with 50 or more employees that file EEO-1 reports, including California employers.

What employers may need to do

  • Keep EEO-1 records and filing readiness in place; current rules apply until a final rule is published.
  • Watch for the final rule and for the 2025 EEO-1 Component 1 collection schedule.
